The Town of Cottesloe Local Planning Scheme No.3 (LPS 3) governs development within the Town, classifies land into zones, and outlines how land within those zones may be used and developed.

Deemed Provisions
Schedule 2 of the Planning and Development Act (Local Planning Schemes) Regulations 2015 includes ‘deemed provisions’ for local planning schemes, which is a set of mandatory provisions containing standardised procedures for all local planning schemes. The deemed provisions form part of, and are read in conjunction with, the Scheme Text.
Deemed provisions for Scheme Text
The deemed provisions replace various provisions of the Scheme Text and prevail where there is any inconsistency, while provisions of the Scheme Text which are not inconsistent with the deemed provisions continue to apply.
The working copy of the Scheme Text above includes reference to the deemed provisions.
Proposed Scheme Amendments
Scheme Amendment 12
Scheme Amendment 12 relates to Nos. 7 and 11 Station Street, Cottesloe and proposes:
- amending the R-Code applicable to the site from R100 to R-AC0
- amending Table 2 – Development requirements and Schedule 12 – Special provisions to include particular requirements for the site and
- adding Schedule 16 – Building Control Diagrams for the site.
Scheme Amendment 12 is currently with the Western Australian Planning Commission for consideration. Council resolved on 22 November 2022 to not support the amendment.
