Proposed Amendment to the Local Government Property Local Law 

In accordance with Section 3.12 of the Local Government Act 1995, public notice is hereby given that the Town of Cottesloe is seeking submissions on a proposed amendment to the Local Government Local Law.

The purpose and effect of this amendment is as follows:

The Purpose: To specify additional activities which may be prohibited on specified local government property by way of a determination under cl. 2.8(1), such activities being:

  • smoking within a 5 metre radius of any entrance, exit or aperture of premises (cl. 2.8(1)(a));
  • releasing an unsecured balloon inflated with a gas that causes it to rise in the air (cl. 2.8(1)(i);
  • smoking in contravention of a sign which prohibits the act of smoking (cl. 2.8(1)(j)).

The Effect: The effect of the Amendment Local Law will be that Council may make determination under cl. 2.8(1) that a person is prohibited from undertaking the following activities on specified local government property.  

  • smoking within a 5 metre radius of any entrance, exit or aperture of premises (cl. 2.8(1)(a));
  • releasing an unsecured balloon inflated with a gas that causes it to rise in the air (cl. 2.8(1)(i);
  • smoking in contravention of a sign which prohibits the act of smoking (cl. 2.8(1)(j)).
